กฎหมายเพื่อป้องกันผลกระทบของยาออกฤทธิ์ต่อจิตประสาทและการขับขี่ต่อความปลอดภัยสาธารณะในประเทศไทยและประชาคมอาเซียน

| dc.description | This research aims to study road safety theories, traffic policies, and legal measures in Thailand, the European Union, Sweden, Germany, and ASEAN related to driving under the influence and to propose policy recommendations and legal measures for Thailand and ASEAN. The research process involves conducting a documentary research in conjunction with in-depth interviews with experts. The findings indicate that control measures in Thailand and ASEAN are still inappropriate, which are different among ASEAN member states. The recommendations from this research, including, first, the main agency for setting and enforcing policies in Thailand should be the same. Second, Thailand should revise definitions in the Road Traffic Act B.E. 2522, define specific alcohol levels for public vehicle drivers, a covered list of psychotropic drugs, testing periods and bans on the use of psychotropic drugs, and fines based on alcohol levels and income, increase penalties, including vehicle confiscation, and enhance rehabilitation and probation activities for drivers. Third, ASEAN should designate a main responsible agency in each country, aim to reduce the number of drivers under the influence to zero, set acceptable lists and levels of drugs, and prevent cross-border driving while under the influence. Finally, ASEAN should prohibit issuing licenses to drivers under the influence, promote the exchange of offense information, develop guidelines for substance quantity, impairment testing, and physical examinations for drivers both domestically and across borders, develop guidelines for setting fines based on alcohol levels and income, and encourage member states to review and align their laws with ASEAN standards. | |
| dc.description.abstract | การวิจัยนี้มีวัตถุประสงค์ เพื่อศึกษาทฤษฎีความปลอดภัยทางถนน นโยบายและมาตรการทางกฎหมายจราจรของประเทศไทย สหภาพยุโรป สวีเดน เยอรมนี และอาเซียนในส่วนที่เกี่ยวข้องกับการขับขี่ภายใต้อิทธิพล และเสนอแนวทางกำหนดนโยบายและมาตรการทางกฎหมายของประเทศไทยและอาเซียน กระบวนการวิจัยประกอบด้วยการทำวิจัยเอกสารร่วมกับการสัมภาษณ์เชิงลึกผู้เชี่ยวชาญ ผลการวิจัยพบว่า มาตรการควบคุมการขับขี่ของประเทศไทยและอาเซียนยังขาดความเหมาะสม และประเทศสมาชิกอาเซียนมีนโยบายและมาตรการทางกฎหมายที่แตกต่างกัน ข้อเสนอแนะจากการวิจัยนี้ ได้แก่ ประการแรก หน่วยงานของประเทศไทยด้านการกำหนดและปฏิบัติตามนโยบายควรเป็นหน่วยงานเดียวกัน ประการที่สอง ประเทศไทยควรปรับปรุงนิยามศัพท์ในพระราชบัญญัติจราจรทางบก พ.ศ. 2522 กำหนดระดับแอลกอฮอล์เป็นพิเศษสำหรับผู้ขับขี่รถสาธารณะ กำหนดรายการยาออกฤทธิ์ต่อจิตประสาทให้มีความครอบคลุม กำหนดระยะเวลาทดสอบผู้ขับขี่และระยะเวลาห้ามการใช้ยาออกฤทธิ์ต่อจิตประสาท กำหนดอัตราค่าปรับตามระดับแอลกอฮอล์และรายได้ เพิ่มโทษริบยานพาหนะ เพิ่มกิจกรรมฟื้นฟูสมรรถภาพและการคุมประพฤติผู้ขับขี่ ประการที่สาม อาเซียนควรกำหนดผู้รับผิดชอบหลักของแต่ละประเทศ ตั้งเป้าหมายลดจำนวนผู้ขับขี่ภายใต้อิทธิพลให้เป็นศูนย์ กำหนดรายการและระดับยาที่ยอมรับได้ และป้องกันการขับขี่ภายใต้อิทธิพลข้ามแดน และประการสุดท้าย อาเซียนควรห้ามการออกใบอนุญาตแก่ผู้ขับขี่ภายใต้อิทธิพลส่งเสริมการส่งต่อข้อมูลการกระทำผิดระหว่างกัน จัดทำข้อแนะนำการกำหนดปริมาณยา แนวทางทดสอบความบกพร่อง และการตรวจร่างกายผู้ขับขี่ภายในประเทศและข้ามแดน จัดทำข้อแนะนำการกำหนดอัตราค่าปรับตามระดับแอลกอฮอล์และรายได้ และให้รัฐสมาชิกทบทวนกฎหมายให้สอดคล้องกับอาเซียน | |
